1. Introduction
Welcome to Garage Club ("we," "us," "our"), a vertical of Amygdala Wearables, operating the website www.amygdalawearables.com (the "amygdala wearables"). By accessing or using the Site, browsing our products, or placing an order, you ("you," "customer," "user") agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Site.
2. Eligibility
To place an order on the Site, you must be:
- At least 18 years of age, or
- Using the Site under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.
You are responsible for ensuring the accuracy of information (shipping address, contact details, payment) provided at checkout.
3. Products
3.1 All products sold by Garage Club are made using a print-on-demand (POD) production model. Each item is produced after an order is placed, unless otherwise stated for a specific limited or pre-made drop.
3.2 Colours and appearance: We make every effort to display product colours, prints, and fabric textures accurately. However, actual colours may vary slightly due to screen settings, lighting, and printing/production variance. Minor variation is not considered a defect.
3.3 Sizing: Please refer to the size chart on each product page before ordering. We are not responsible for size selection errors made at checkout, though our Returns & Refunds Policy explains your options if the fit is not right.
3.4 Availability: Product availability, pricing, and descriptions are subject to change without notice. We reserve the right to limit quantities, discontinue a product, or correct pricing errors, including after an order is placed, in which case we will notify you and offer a refund or alternative.
3.5 Original designs: All designs, graphics, and artwork are original creations of Garage Club/Amygdala Wearables unless explicitly licensed. We do not use team logos, driver names/numbers, or other third-party trademarks without authorization.
4. Orders and Payment
4.1 By placing an order, you make an offer to purchase the product(s) at the listed price. We reserve the right to accept or decline any order (e.g. suspected fraud, pricing errors, stock issues).
4.2 An order is confirmed only once you receive an order confirmation email/message and payment has been successfully processed.
4.3 We accept payments via [UPI, credit/debit cards, net banking, wallets, COD if applicable] through our third-party payment gateway. All prices are listed in Indian Rupees (₹) and are inclusive/exclusive of applicable taxes as indicated at checkout.
4.4 Because products are made to order, we are unable to modify or cancel an order once production has begun. See Section 5 for the cancellation window.
5. Order Cancellation
5.1 You may request cancellation within 2 hours, of placing your order, provided production has not yet started. Contact us at admin.amygdalawearables@gmail.com/WhatsApp immediately with your order number.
5.2 Once an order enters production, it cannot be cancelled, as each item is custom-manufactured for you.
5.3 We reserve the right to cancel any order due to stock unavailability, pricing errors, suspected fraud, or inability to ship to the provided address. In such cases, a full refund will be issued.
6. Shipping
6.1 Orders are typically produced within [X–Y business days] and shipped within [X–Y business days] thereafter, depending on the product and location. Estimated delivery timelines shown at checkout are estimates, not guarantees.
6.2 Shipping charges (if any) are shown at checkout before payment.
6.3 Risk of loss and title for products pass to you upon delivery to the courier/logistics partner, though we will assist in resolving issues with lost or damaged shipments (see Returns & Refunds Policy).
6.4 We are not liable for delays caused by courier partners, customs, natural events, strikes, or other circumstances beyond our reasonable control.
7. Returns, Refunds, and Exchanges
Returns, exchanges, and refunds are governed by our separate [Returns & Refunds Policy], which forms part of these Terms.
8. Intellectual Property
8.1 All content on the Site — including but not limited to the Garage Club name, logo, product designs, graphics, photography, copy, and the "Amygdala Wearables" name and branding — is the property of M Enterprises and protected under applicable copyright, trademark, and intellectual property laws.
8.2 You may not reproduce, distribute, modify, or create derivative works from any Site content, product design, or branding without our prior written consent.
8.3 Any user-generated content shared with us (e.g. reviews, tagged photos, testimonials) may be used by us for marketing purposes across our channels, unless you notify us otherwise.
9. Prohibited Use
You agree not to:
- Use the Site for any unlawful purpose
- Attempt to gain unauthorized access to our systems or another user's account
- Interfere with the Site's security or functionality
- Use automated means (bots, scrapers) to access the Site without permission
- Submit false, fraudulent, or misleading order or payment information
We reserve the right to suspend or terminate access for users who violate these Terms.
10. Limitation of Liability
10.1 To the maximum extent permitted by law, Garage Club and Amygdala Wearables shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or products, including but not limited to loss of data, loss of profits, or business interruption.
10.2 Our total liability for any claim arising from an order shall not exceed the amount paid by you for that specific order.
10.3 Nothing in these Terms limits any liability that cannot be excluded under applicable Indian consumer protection law.
11. Indemnity
You agree to indemnify and hold harmless Garage Club, Amygdala Wearables, and their respective officers and employees from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Site.
12. Third-Party Links
The Site may contain links to third-party websites (e.g. Instagram, payment gateway). We are not responsible for the content, policies, or practices of these third-party sites.
13. Modifications to Terms
We may revise these Terms at any time. Changes take effect upon posting to the Site. Continued use of the Site after changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of City of New Delhi.
15. Grievance Redressal
In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Act, 2000, complaints may be addressed to:
